What to Do After a Fatal Two-Car Crash in Stockton, CA
Statewide, the California Office of Traffic Safety counted 4,061 traffic deaths in 2023, the most recent year with finalized figures. Crashes that happen inside a city often have several sources of evidence that can disappear within days, so the first steps matter.
- Ask the Stockton Police Department for the collision report and keep the case number the responding officers give you.
- Ask the hospital or the Stockton Police Department whether the family can receive the official notice of death, and ask the San Joaquin County coroner for the death certificate.
- Ask where both vehicles were towed, and ask that neither be released or salvaged until an attorney or qualified inspector has examined them.
- Request video from nearby businesses and traffic cameras around El Dorado and Park streets right away, since many systems overwrite recordings within days.
- Write down the names and phone numbers of any witnesses, and save any messages or photos from the scene.
- Do not give a recorded statement to any insurance company before speaking with an attorney. Keep a written list of every call from an adjuster.
Legal Options for a Family After a Fatal Crash in Stockton
Several parties could bear responsibility once the investigation shows what happened. The police report does not yet say what caused the collision, and no arrests have been made. Depending on the facts, the other driver’s conduct, a city street condition, or a signal could all matter.
California follows a pure comparative negligence rule. A family can recover damages even if the victim is found partly at fault, with the award reduced by that share. Insurers often assign partial blame to lower what they pay, so the legal standard should guide every response.
A wrongful death claim in California generally must be filed within two years of the date of death, which means by October 17, 2028. El Dorado and Park streets are city streets. If a claim involves a public entity, such as a signal problem or a road defect, a written government claim must be filed within six months under Government Code section 911.2, which means by April 17, 2027.
A wrongful death claim lets surviving spouses, children, and certain dependent relatives pursue funeral costs, lost financial support, and loss of companionship. A survival claim belongs to the estate and covers losses the woman suffered before she died.
