Sacramento, CA (Sept 8, 2026) – The California Highway Patrol is investigating a deadly crash on westbound Highway 50 in Sacramento Tuesday night.
The crash was reported just before 10 p.m. on the W/X portion of the highway, east of Interstate 5, CHP said. A man was reported to have been walking in the lanes of traffic and was struck west of the 10th Street off-ramp.
A CHP spokesperson said it was unclear whether the driver who hit the man remained at the scene. Five lanes of the highway were closed following the crash, while two remained open.
The investigation into the circumstances of the crash remains ongoing.
Our thoughts are with the man’s family and loved ones during this incredibly difficult time.
Legal Options After a Fatal Pedestrian Accident on a California Highway
A pedestrian being struck on a highway raises difficult and often complicated questions, especially when it’s unclear whether the driver stayed at the scene. Here’s what families should understand as this investigation unfolds.
Hit-and-run cases have special protections. If it’s confirmed the driver left the scene, California law provides certain protections for victims of hit-and-run collisions, including the potential to pursue a claim through your own uninsured motorist coverage if the driver is never identified.
Wrongful death claims may apply. If the driver is identified and negligence, such as speeding, distraction, or failing to see a pedestrian in time, contributed to the crash, the surviving family may have the right to pursue a wrongful death claim.
Fault can be complicated on a highway. Because highways are not designed for pedestrian traffic, determining fault often requires a careful, independent investigation into why the man was in the roadway, the driver’s ability to see and react, and lighting and visibility conditions at the time.
Evidence should be preserved quickly. Surveillance footage, vehicle data, and physical evidence at a highway crash scene like this one can be lost or overwritten within days. An attorney can help ensure this evidence is identified and preserved while facts are still being gathered.
Time limits matter. California generally allows two years from the date of a crash to file a claim, though early legal guidance can help protect evidence and strengthen a case from the start.
Every case is different, and no outcome can be guaranteed. But understanding your options as early as possible is one of the most important steps a grieving family can take.
