El Cajon, CA (May 21, 2026) – The California Highway Patrol confirmed two men died yesterday after a head-on, rollover collision on Interstate 8 near Lake Jennings Park Road in El Cajon. According to CHP, the crash occurred around 11 a.m. when a 24-year-old was driving a Toyota RAV4 eastbound on I-8 near Lake Jennings Road. A 43-year-old was driving a Honda Accord westbound in the same area.
For reasons still under investigation, the Toyota reportedly veered left toward the center median, eventually crossing into the westbound traffic lanes and crashing head-on into the Honda. The 43-year-old driver of the Honda died at the scene.
The 24-year-old driver of the Toyota was transported to the hospital with major injuries and later died, according to authorities. Both men were reportedly from El Cajon.
The crash temporarily shut down a stretch of I-8 near Lake Jennings Park Road. All lanes have since reopened.
CHP says the investigation is ongoing and that drugs and alcohol were not factors.
Losing someone to a freeway crash is one of the most sudden, disorienting losses a family can face. The questions come fast, and the answers rarely do.
What to Do After a Fatal Car Accident in California
When a crash takes a life, families are left navigating both grief and a legal system that moves whether they are ready or not. Acting quickly protects the family’s options.
What families should know after a fatal crash in California:
Can a civil claim move forward while the investigation is still open? Yes. A CHP investigation and a wrongful death claim run on separate tracks. Families do not have to wait for CHP to close its investigation before consulting an attorney and preserving evidence.
What can a wrongful death claim cover? California wrongful death claims can cover funeral and burial costs, medical expenses incurred before death, the economic value of the support the deceased would have provided, and non-economic losses, including grief, loss of companionship, and loss of guidance. These damages are available to surviving spouses, domestic partners, and children.
What does “under investigation” mean for the family? CHP’s ongoing investigation focuses on criminal or administrative fault. A civil wrongful death claim uses a separate standard — negligence — and can proceed regardless of whether criminal charges are ever filed. Evidence from the CHP investigation, including the crash report, vehicle data, and witness statements, can be obtained by a civil attorney through formal channels.
What is the filing deadline? California’s statute of limitations for wrongful death claims is two years from the date of death under California Code of Civil Procedure § 335.1. For a death occurring on May 21, 2026, that deadline falls on May 21, 2028. Acting sooner preserves evidence — surveillance footage, vehicle data, and witness accounts become harder to recover as time passes.
Do not speak with any insurance company — including the at-fault driver’s insurer — without first consulting an attorney. Recorded statements in the early days of a claim are used to reduce or deny compensation. Request and preserve all medical records from the receiving hospital. Do not accept any settlement offer before a full assessment of the claim’s value has been completed. Contact an attorney who handles California wrongful death claims before making any decisions.
