What Families Can Do After a Fatal Motorcycle Crash in California
California recorded 583 motorcyclist deaths in 2023, down 10.2 percent from 649 the year before, according to the California Office of Traffic Safety. The same report counted 33 motorcyclist deaths involving riders who were not wearing a helmet in 2023, compared with 43 in 2022. California requires every rider and passenger to wear a helmet that meets federal safety standards, under Vehicle Code section 27803.
In the days after a fatal crash, a few practical steps protect a family’s options while the investigation is still open.
- Ask the San Jose Police Department’s Traffic Investigations Unit for the report number and the assigned investigator, since the completed report can take weeks.
- Ask that the motorcycle, the helmet, and the riding gear not be repaired, cleaned, or sold for salvage, because they carry physical evidence.
- Photograph the intersection and the sight lines in daylight, before weather, roadwork, or vegetation changes the scene.
- Note nearby homes, businesses, and parked vehicles that may hold camera footage, since many systems record over themselves within days.
- Route insurance calls to one family member or to a lawyer, and give no recorded statement while facts are unsettled.
- Order several certified copies of the death certificate, and keep every funeral, ambulance, and hospital bill in one place.
Right-of-Way and Liability in a Santa Clara County Motorcycle Crash
Crashes between a motorcycle and a car near an intersection usually turn on a single question: who had the right of way, and who entered the other’s path. San Jose police have not stated a cause here, and nothing in the investigation so far assigns fault to anyone.
That question is answered by physical evidence rather than by memory. Scene measurements, the angle and depth of the damage on both vehicles, the final rest positions, and any recorded video usually matter more than what either side believes happened. Motorcycle cases also carry a known bias, because insurers often argue speed or lane position before anyone has measured either.
When a rider dies, California law creates two separate claims. A wrongful death claim belongs to close family members and covers their own losses, including financial support and the loss of the person’s companionship. A survival claim belongs to the rider’s estate and covers what he lost between the impact and his death, including medical expenses.
- Who may be liable: the driver of the other vehicle, an employer if that vehicle was being used for work, or a public entity if a roadway condition is shown to have contributed.
- What decides it: the police report and scene diagram, vehicle damage analysis, third-party camera footage, independent witnesses, and data stored by either vehicle.
- Comparative fault: California follows pure comparative fault, so a family can still recover even if the rider is assigned a share of the blame, with the award reduced by that percentage.
- Deadlines: wrongful death claims generally must be filed within two years of the date of death, which is October 4, 2028 here (CCP 377.60), and the two-year personal injury window under CCP 335.1 runs to the same date. If a roadway condition becomes part of the investigation, a claim against the responsible public entity must be presented within six months, by April 4, 2027 (Govt. Code 911.2). Missing that six-month filing bars the lawsuit entirely.
